On or about April 15, 2007, at a currency exchange located at or about 6858 South Ashland Avenue, Chicago, while off
duty, he intentionally and/or knowingly without legal justification made physical contact of an insulting or provoking nature with Jimmy/James Brown, in that the Respondent pushed Jimmy/James Brown on the neck and/or chest and/or shoulder area, in violation of Chapter 720
ILCS 5/12-3(a)(2).

On or about April 15, 2007, at the currency exchange located at or about 6858 South Ashland Avenue,Chicago, while off duty, he pushed on the neck and/or chest and/or shoulder area a civilian, Jimmy/James Brown, who
knew the Respondent to be a police officer, and/or pushed
newspapers that were on the window ledge onto the floor,
thereby impeding the Department's efforts to achieve its
policy and goals and/or bringing discredit upon the Department.

The Superintendent did not prove by a preponderance of the evidence that on or about April 16, 2007, at the currency exchange located at or about 6858 South Ashland Avenue, Chicago, while on duty, the
Respondent arrested a civilian, Jimmy/James Brown, in
retaliation for Jimmy/James Brown filing a complaint
against the Respondent with the Office of Professional
Standards (now the Independent Police Review Authority),
thereby impeding the Department's efforts to achieve its
policy and goals and/or bringing discredit upon the Department.

On or about April 15, 2007, at the currency exchange
located at or about 6858 South Ashland Avenue, Chicago,while off duty, he pushed on the neck and/or chest and/or shoulder area a civilian, Jimmy/James Brown, thereby engaging in an unjustified physical altercation with any person while off duty.
