James Uginchus

On or about August 11, 2001, at or near 7924 South Kildare, Chicago, Illinois, Officer Uginchus, while off duty and without lawful authority, approached 12-year-old Matthew Basile in a menacing manner and/or flicked cigarette ash and/or a lighted cigarette -in Basile's direction, placing him in reasonable apprehension of receiving a battery, thus committing aggravated assault in violation of Illinois Compiled Statutes chapter 720 ILCS 5/12-2(a)(1).

On or about August 11, 2001, at or near 7924 South Kildare, Chicago, Illinois, Officer Uginchus, while off duty and without lawful authority, approached Bridget Basile in a menacing manner and/or brandished garden shears, placing her in reasonable apprehension of receiving a battery, thus committing aggravated assault in violation of Illinois Compiled Statutes chapter 720 ILCS 5/12-2(a)(1).

On or about September 13, 2001, at or near 7918 South Kildare,Chicago, Illinois, Officer Uginchus, knowingly transmitted tb a police officer a report of an assault which he knew was groundless, thus
engaging in disorderly conduct in violation of Illinois Compiled Statutes chapter 720 ILCS 5/26-1(a)(4).

On or about September 13, 2001, at or near 7918 South Kildare, Chicago, Illinois, Officer Uginchus, knowingly transmitted to a sergeant of police a report accusing a neighbor of causing damage to his property which he knew was groundless, thus engaging in disorderly conduct in violation of Illinois Compiled Statutes chapter 720 ILCS 5/26-1(a)(4).

On or about September 21, 2001, Officer Uginchus appeared at the offices of the Internal Affairs Division to provide a formal statement to pending charges, and during that statement he admitted that he had purchased and possessed a Smith & Wesson .9 mm handgun, serial number VDL2482, which was not registered, thus violating City of Chicago Municipal Code, Chapter 8-20, Section 040.

On or about August 11, 2001, while off duty in the vicinity of 7924 South Kildare, Officer Uginchus maltreated Bridget Basile in that he yelled at her and/or directed profanities toward Ms. Basile.

On or about August 11, 2001, at or near 7924 South Kildare, Chicago, Illinois, Officer Uginchus approached 12-year-old Matthew Basile in a menacing manner and flicked cigarette ash and/or a lighted cigarette in Basile's direction, placing him in reasonable apprehension of receiving a battery, and was subsequently arrested thereby impeding the Department's efforts to achieve its policies and goals and/or bringingndiscredit upon the Department.

On or about August 11, 2001, at or near 7924 South Kildare, Chicago, Illinois, Officer Uginchus unjustifiably yelled at and/or directed profanities toward Matthew Basile and/or Bridget Basile and/or Virginia Green thereby impeding the Department's efforts to achieve its policies and goals and/or bringing discredit upon the Department.

On or about August 11, 2001, Officer James E. Uginchus submitted to a Breath Alcohol Test which results revealed that he had a blood alcohol level of approximately 0.102%, thus being intoxicated while off duty, thereby impeding the Department's efforts to achieve its policies and goals and/or bringing discredit upon the Department. or about August 11, 2001, Officer James E. On or about August 11, 2001, while off duty in the vicinity of 7924 South Kildare, Officer Uginchus maltreated Virginia Green in that he yelled at her and/or directed profanities toward Ms. Green.

On or about August 11, 2001, Officer James E. Uginchus submitted to a Breath Alcohol Test which results revealed that he had a blood alcohol level of approximately 0.102%, thus being intoxicated while off duty.
